THEISEN’S MORE CLUB REWARDS PROGRAM TERMS AND CONDITIONS

The Theisen’s More Club Rewards Program (the “Program”) is offered at the sole discretion of Theisen’s Home Farm Auto and Theisen Supply, Inc. (“Theisen’s” “we” “us” “our”). Your participation in the Program is your full and unconditional agreement to, and acceptance of, these Terms & Conditions, and of all decisions made by Theisen’s in administering the Program, which are final and binding.
This Program allows Theisen’s More Club Rewards members (“Members” “you” “your”) to earn points for dollars spent on eligible purchases at Theisen’s, or in other ways described in the Program. Once you earn enough points, you will receive a Reward that can be redeemed towards purchases at Theisen’s stores, or on its website.
Program Requirements, Enrollment, and Limitations
Membership in the Program is free, and available to individuals who are: (i) at least eighteen (18) years of age; (ii) a resident of the United States; (iii) allowed by applicable law; and (iv) in compliance with these Terms & Conditions. Theisen’s, in its sole discretion, has the right to allow, limit, or restrict participation by corporations, businesses, charities, partnerships, enterprises, governmental entities, resellers, or any other person or entity, except for a reason that is protected by law. Nothing under this Program and the present Terms & Conditions shall be construed as setting minimum purchase requirements. Members enroll in the Program in store or online, by: (i) providing first name, last name, valid and unique e-mail address, mobile phone number with text, and residential address; (ii) accepting these Terms & Conditions and all related policies; and (iii) completing the member profile. Only one Theisen’s More Club Rewards account is allowed per person/household, per e-mail address, or per phone number. You cannot transfer, sell, exchange, or allow others to use your points or rewards. Members agree: (i) To provide only true and accurate information when registering for the Program; (ii) To abide by the rules and regulations of the Program, as such rules and regulations are posted on Theisen’s website; (iii) To comply with the terms of all offers, promotions and programs, whether offered by Theisen’s or by any of its commercial partners; and, (iv) Not to abuse the Program, such as by accruing points with the intent to resell for commercial purposes or otherwise in a manner that is inconsistent with Theisen’s policies. Each member is responsible for remaining knowledgeable about the Program terms and conditions. Member should promptly notify Theisen’s of any changes to personal information, such as name, address, telephone number, and email address, either by visiting https://www.theisens.com or by calling Customer Service at 1-866-245-6850.
Program Disclaimer
Participation in the Program is subject to all terms and conditions, rules, regulations, policies and procedures that Theisen’s may, at its discretion, adopt from time-to-time. Theisen’s reserves the right to terminate your further participation, and eliminate any pending, current, or future points or rewards balance, or otherwise disqualify Members who have violated any of these Terms & Conditions. At its sole discretion, Theisen’s has the right to modify, add or delete any of the Program rules, terms, conditions, benefits or rewards, in whole or in part, at any time, with or without notice, even though such changes may affect the value of points already accumulated, the value of the rewards, and/or the time for redemption. Participation in the Program is void if prohibited by law in the jurisdiction in which the prospective participant resides. The Program is a United States Program and is governed by United States law in the state of Iowa. If in any particular state the Program or Theisen’s has to apply for any special license, bonding, permit, or other governmental regulatory approval, the Program will be void in that particular state.
Earning Points
To earn Program points, you must identify yourself as a Theisen’s More Club Reward Member each time you shop or place an order at Theisen’s Home Farm Auto, by entering your telephone number associated with your membership account. If shopping on https://www.theisens.com, you must identify yourself by logging into your account before completing check out. You must also take the purchased item with you, or have it shipped to you. Points are earned when you are charged and pay for your items and take it with you; however, online order points are earned when your items are shipped and your credit or debit card is charged. Members will earn at least one (1) point for every dollar ($1.00) of eligible purchases (“Qualified Purchases”) made at Theisen’s Home Farm Auto stores and online at https://www.theisens.com. Qualified Purchases include regular and sale priced merchandise, unless excluded. Theisen’s may exclude products from the Program at its sole discretion or as required by law. Points will not be earned on purchases of hunting/fishing licenses, trailer/tax registration, gift cards, merchandise credits in the form of a gift certificate, the portion of a purchase that applies from a Program reward, and all charges for warranties, taxes or shipping. Earned points will be posted to your account, which may take two (2) business days from the date of a Qualified Purchase. For every increment of 500 points earned, you will receive five-dollars ($5.00) in reward credits to be applied as a discount to a future Qualified Purchase. If you return purchases on which you earned points, those points will be deducted from your member account. If you return an item that was purchased with rewards, the same amount of reward points will be re-credited to your member account. If any deduction puts your account into a negative points balance at the time of the return, you will not be eligible to use your points for a reward until you earn a positive balance. It is your responsibility to ensure accurate points are posted to your account. You will not receive cash or credit card or debit card credits for returned rewards redemptions.
Redeeming Points
You will automatically be able to redeem points posted to your account in increments of five-dollars ($5) for every threshold of 500 points. The points can be redeemed only one-time for eligible merchandise or services at Theisen’s Home Farm Auto stores or online at https://www.theisens.com. When points are redeemed as a reward, they will be deducted from your Program account. You can use your earned rewards on Qualified Purchases at any time between the date that they become posted to your account and either (i) the expiration date of the reward or (ii) the termination of the Program, whichever is earlier. Rewards may not be combined with other Theisen’s coupons, certificates, or offers, unless stated otherwise. Points will be earned on Qualified Purchases in excess of the value of the reward used for that purchase. Points earned through the Program will never expire as long as the account remains open, active, and in good standing. To remain active, the account or the rewards must be used at least once in a twenty-four (24) month period. Once a reward expires, it cannot be used. Points have no cash value and may not be redeemed for cash or applied toward any credit card balances. The points or rewards are not property, and you have no property interest in the points or rewards. Theisen’s is not responsible for lost, stolen, or mis-delivered member points or rewards. The points/rewards may be subject to federal, state, or other income, sales, use or other taxes arising out of the accrual or use of points. You are solely responsible for any tax consequences related to the Program and consulting your own tax advisor. Furthermore, as a user of the Theisen's More Club rewards program, you agree NOT to:
> Misuse or abuse any coupons/discounts, coupon/discount codes, loyalty points or loyalty point coupon/discount codes
> Combine coupon/discount codes or promotional codes in a manner not intended or permitted by us
> Create multiple accounts or using false information to obtain additional discounts or benefits
> Repeatedly place orders to take advantage of unintended pricing or promotional or coupon/discount outcomes
> Exploit pricing errors, system glitches, or unintended functionality. Additionally, you agree not to misuse or abuse any promotions, discounts, or coupon/discount codes offered on this Site. This includes, without limitation, combining promotions or discounts in a manner not intended by us, eploiting pricing errors or system glitches/loopholes, creating multiple accounts to obtain additional benefits, or otherwise attempting to obtain products at unintended or unauthorized prices. If these actions are found to be taken by you, we reserve the right, in our sole discretion, to cancel or refuse any order, revoke discounts, limit quantities, deactivate accounts, refuse service, and persue any available remedies, including seeking reimbursement, where such activity is identified.
Receipt Upload Policy
The receipt upload feature is provided as a courtesy to allow members to receive points for eligible purchases when their More Club account was not applied at the time of transaction.
By using this feature, you agree that all submitted receipts must be valid, unaltered, and associated with your own purchase. Submission of duplicate receipts, altered receipts, or receipts belonging to another individual is strictly prohibited.
Theisen’s reserves the right to review all receipt submissions for accuracy and authenticity. Any misuse or abuse of the receipt upload feature—including, but not limited to, submitting duplicate, fraudulent, or unauthorized receipts—may result in the denial of points, reversal of previously awarded points, and/or suspension or termination of your More Club account.
Program Benefits, Bonus Awards, Special Program Member Offers
During the Program, Members will have the opportunity for each of the following additional benefits:
• Points on Qualified Purchases made at Theisen’s Home Farm Auto stores and online at https://www.theisens.com at the rate of at least one (1) point for every $1 spent; and for every 500 points, the Member will receive a credit of Five Dollars ($5.00) in rewards.
• Monthly, Theisen’s will have exclusive savings events for Members only. These events will be communicated to Members by email or text.
• Members will receive 500 bonus points on the day of their birthday in each calendar year. To obtain these points, the Member must log into their account and provide their birthday and click on “Submit.” If your birthday is within the next 30 days when entered into the Program, posting of the points to your account may be delayed up to 30 days.
• Members will receive up to 500 bonus points for following Theisen’s on social media. To obtain these points, the Member must log into their account and click on “Follow” within the box for Facebook (250 points) and Instagram (250 points), and sign into the Facebook/Instagram account.
• Members can earn 10 bonus points for every product review they submit. To obtain these points, the Member must have purchased the product from Theisen’s, and must personally write and leave the review online.
• Monthly Drawing for a $100 Theisen’s Stores Gift Card, subject to the following additional terms and conditions:
· Each month, eligible participants will be enrolled in a drawing for the chance to win a $100 Theisen’s Stores Gift Card to be rewarded as 10,000 points to your More Club account
· Members who have (i) made a purchase in the previous month, and (ii) “opted in” to receive marketing emails, will be automatically enrolled.
· No Purchase Necessary. Your chances are not affected by any purchase or any volume of purchases. Anyone not automatically enrolled may enter the drawing without purchase by sending or delivering an e-mail to customerservice@theisens.com or a hand-written 3”x5” postcard, to our Customer · Service Department at the following address: ATTN: Customer Service, 6209 Chavenelle Rd, Dubuque, IA 52002. The e-mail or postcard must be signed and dated, and legibly state your name, address, telephone number, and e-mail address, and must be received the day before the drawing. If received after that date, the submitted entry will be entered into the following monthly drawing. Theisen’s shall not be liable for late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries.
· The $100 Theisen’s Stores Gift Card will be awarded in a random drawing held on the 5th day of each month, from and among all eligible entries received. Odds of winning depend on the number of eligible entries received.
· No prize is redeemable for cash. This drawing is open to legal residents of the United States who are eighteen (18) years or older at the time of entry. · One drawing entry per person per month is allowed. Void where prohibited.
· You need not be present to win. Winners are notified via the phone number or address provided. Except where prohibited by law, entry constitutes permission to use winners’ names, hometowns and likeness for online posting, and/or any advertising and publicity without additional compensation.
Theisen’s reserves the right to provide Program benefits to some Members based on geographic location, Program participation, purchases made, or information supplied by the Member or by our vendors. From time to time, at its sole discretion, Theisen’s may extend additional benefits and offers, or make bonus offers to let Program Members earn additional rewards (“Bonus Rewards”). Members should read each offer carefully for important conditions or limitations, such as blackout periods, Bonus Reward limits, or exclusions. Members may have to register separately to qualify for certain Bonus Rewards. Theisen’s may change or withdraw an offer at any time without notice, but this will not affect any Bonus Rewards already earned. Certain offers may only be communicated via email. Theisen’s may also extend enrollment offers to promote new Program membership for non-members. Such enrollment offers are limited to new Theisen’s More Club Rewards Members. Existing Members may not receive enrollment offers for enrolling in additional Theisen’s More Club Rewards accounts.
Program Communication
By participating in the Theisen’s More Club Rewards, you agree to allow Theisen’s, and its promotional partners, to communicate with you about the Program, points, rewards, promotions, coupons, information, offerings that may be of interest to you, or anything relating thereto via mail, email, phone, text, in-app notification, external websites, and various other channels, including through the use of automatic dialing systems, voice message systems, text message systems, social media message systems, and automated email systems to the extent allowed by law or as agreed upon by you. You acknowledge that automated calls or text messages may be made to your telephone number(s) even if your telephone number(s) is registered on any state or federal Do Not Call list. Theisen’s may collect, use, and disclose Member’s data consistent with its Privacy Policy. You understand that when you receive a message by any of the above means, you may incur a charge from the company that provides you with telecommunications, wireless and/or Internet Services, and you agree that Theisen’s will have no liability for such charges. You expressly authorize the monitoring and recording of calls. You do not have to agree to receive automated promotional calls/texts as a condition of purchasing any goods or services. You may, at any time, withdraw your consent to receive emails, text massages, calls to your cell phone, or to receive artificial or prerecorded voice message systems calls by contacting us at 1-866-245-6850 or by emailing customerservice@theisens.com.
Program Cancellation and Termination
Theisen’s More Club Rewards Program has no predetermined termination date and may continue until such time as Theisen’s, in its sole discretion, elects to designate a termination date. Theisen’s reserves the right, in its sole discretion, to terminate, cancel or suspend the Theisen’s More Club Rewards Program, in whole or in part, at any time, with or without notice. In the event of termination, all points earned on the accounts will be forfeited; provided that you will be entitled to receive any and all rewards accrued prior to the termination date.
Theisen’s reserves the right to cancel any account for which it has incomplete, inaccurate, false, or fictitious personal information. Any fraudulent or unauthorized use of the Program, the account, or any promotional offers or e-gift card rewards is strictly prohibited and may result in termination or disqualification from the Program, forfeiture of all points earned, forfeiture of rewards earned, and/or legal prosecution. In addition, Theisen’s reserves the right to deactivate accounts that have not earned points for a qualifying purchase at least once in a 24-month period. In the event that an account is canceled or de-activated, all points earned on the account will be forfeited.
You may terminate your Theisen’s More Club Rewards account at any time by calling us at 1-866-245-6850 or by emailing customerservice@theisens.com. If you terminate your account, it will be deactivated and you will forfeit any and all points in your account, and you will be ineligible for any offers made to new Theisen’s More Club Rewards participants or enrollees for a period of twelve (12) months after the date on which you terminated your account.
Disputes About Awards
If you believe that you earned points or rewards that have not posted to your account, or that the points or rewards posted were less than what they should have been, or if you have any other questions regarding your account, you must contact the Theisen’s More Club Rewards Customer Service Department within ninety (90) days of the original transaction by (i) calling 1-866-245-6850 or by emailing customerservice@theisens.com; and, (ii) upon request, providing written confirmation of the dispute and the applicable purchase receipt (“Rewards Dispute”). If you do not provide the requested information, we can decide not to investigate your claim. If you do not meet this deadline, you waive your right to make a Rewards Dispute and no adjustments will be made by Theisen’s. You cannot submit the same Rewards Dispute more than one time. If you meet these conditions, we will investigate your Rewards Dispute and notify you of the results of our investigation, as well as posting any missing points or correcting the amount of any reward found to be incorrect. After we have made a decision and notified you, that decision becomes final. Theisen’s reserves the right to interpret and apply all policies and procedures of these Terms & Conditions. All decisions regarding application or interpretation of these Terms & Conditions by Theisen’s is final and conclusive.
Waiver Of Class Action Rights And/Or Claims
You agree that, to the extent you have or believe that you have, any claims against Theisen’s relating to the Program, points, rewards, and/or e-gift cards relating thereto, you will bring those claims in your individual capacity, and not as a plaintiff or class member in any purported class action lawsuit or representative proceeding, consolidation action, or private attorney general action. Unless both you and Theisen’s agree, no arbitrator or judge may consolidate more than one person’s claims or otherwise preside over any form of a representative class proceeding. If this specific provision, known as a “Class Action Waiver”, is found to be unenforceable, then any defective provision shall be severed from the enforceable portions of these Terms & Conditions.
Hold Harmless
To the fullest extent permitted by law, you agree to indemnify, defend and hold harmless Theisen’s and all associated entities, officers, directors, employees, agents, affiliates, subsidiaries, successors, assigns, insurers, advisors, and sub-contractors as their interests may appear, from and against any and all losses, claims, suits, damages, penalties, fines, judgment, liabilities (including without limitation, death, personal injuries, expenses, attorney fees and costs incurred) in connection with your participation in the Program that is inconsistent with these Terms & Conditions.

THIS PROGRAM AND ALL CARDS, ACCOUNTS, POINTS, REWARDS, USED OR PROVIDED AS PART OF THIS PROGRAM ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE HEREBY SPECIFICALLY DISCLAIM ANY AND ALL REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE PROGRAM, MEMBERSHIP IN THE PROGRAM, OR ANY PRODUCTS OR SERVICES RELATED TO, OR DELIVERED UNDER THE PROGRAM, INCLUDING, WITHOUT LIMITATION OF THE FOREGOING, ANY WARRANTY REGARDING OWNERSHIP, NON-INFRINGEMENT, ACCURACY, TIMELINESS, COMPLETENESS, AND AVAILABILITY, AND ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR THOSE ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE.
Limitation Of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAWS, WE DISCLAIM LIABILITY, AND YOU AGREE THAT WE ARE NOT LIABLE, FOR ANY LOSSES AND EXPENSES OF WHATEVER NATURE AND HOWSOEVER ARISING OUT OF YOUR PARTICIPATION IN THE PROGRAM, INCLUDING WITHOUT LIMITATION ANY DIRECT, INDIRECT, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, LOSS OF USE, LOSS OF DATA, LOSS CAUSED BY A VIRUS, CLAIMS OF THIRD PARTIES, OR OTHER LOSSES OF ANY KIND OR CHARACTER, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THEISEN’S, ITS LICENSORS, EMPLOYEES, OR AGENTS TO YOU, OR ANY OTHER PARTY, EXCEED, IN THE AGGREGATE FIVE HUNDRED DOLLARS ($500). YOUR CLAIM FOR SUCH DAMAGES IS OUR SOLE LIABILITY, AND YOUR EXCLUSIVE REMEDY, IN THE EVENT OF THE BREACH BY US OF THIS AGREEMENT. THE FOREGOING SHALL APPLY NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY REMEDY YOU MIGHT HAVE.
Statute Of Limitations
You agree to bring any and all claims or actions relating to program, points, rewards, or e-gift cards relating thereto within one (1) year after such alleged cause of action arose. If there is an outstanding claim from more than one (1) year of such action, then you agree that the statute of limitations would be exceeded, and the claim will be barred.
Governing Law/Jury Waiver
The Program is governed by the laws of the State of Iowa and the United States but does not include any conflict of law rule that might direct or refer determination of any such matter to the laws of any other jurisdiction. Any dispute arising out of these Terms & Conditions or the Program must be resolved in a court of competent jurisdiction in Dubuque County, Iowa. YOU AGREE TO WAIVE YOUR RESPECTIVE RIGHTS TO TRIAL BY JURY OF ANY CAUSE OF ACTION, CLAIM, COUNTERCLAIM OR CROSS COMPLAINT IN ANY ACTION ARISING OUT OF OR CONNECTED IN ANY MANNER WITH THIS PROGRAM, INCLUDING ANY ACTION FOR BODILY INJURY, DEATH OR PERSONAL PROPERTY DAMAGE.
Intellectual Property
The Theisen’s logo, and its other logos and taglines, are the intellectual property of Theisen’s. Artwork, photography, and logos, including the logos and taglines used in conjunction with the Rewards Program, on this website or in print, are the intellectual property of Thiesen’s. These logos and materials are protected by copyrights, trademarks, service marks, patents and/or other intellectual property rights and laws, and may not be used, reproduced, replicated or doctored in any manner without the express written consent of Theisen’s.
Miscellaneous
If it is determined that any provision of these Terms & Conditions is void or unenforceable, all other terms and conditions will continue in full force and effect. In the event that Theisen’s delays enforcement or fails to exercise its rights under these Terms & Conditions, it shall not be deemed any waiver of such rights, including for any future occasion. These Terms & Conditions contain the entire understanding between you and Theisen’s regarding the Program and supersedes all prior Terms & Conditions or other agreements between the parties.
